Personal

Clinical Negligence As the result of a medical accident an entrepreneur suffered life-threatening after-effects for many years. He was just at the critical point of restructuring and redirecting the focus of his business in a niche market. We prepared projections of what his likely earnings would have been if he had been in his pre operative state of health. As a result a settlement in excess of £1 million was agreed.

Personal Injury A sheep hill farmer was seriously injured in a road traffic accident and claimed large losses of earnings. The claim was based on the likely earnings of a farm manager, even though one was not engaged, and his son also worked on the farm. We were able to demonstrate to the court's satisfaction that while there were losses, these were nowhere near the amount claimed and were substantially due to the very difficult times existing in the farming industry.

Fatal Accident A lady with her own dressmaking business died as a result of a medical accident. Her husband was the company secretary but also ran his own pyrotechnic firm. The profitability of both businesses suffered a downturn in the 2-3 years when her health was deteriorating. We assessed their likely incomes but for the event and following the precedent of Coward -v- Comex Houlder Diving we calculated the husband's dependency claim.


Business

Commercial A consortium of Italian companies claimed against a UK listed company for breach of contract. We worked closely with the expert engineer and also had to deal with the complex Italian employment and commercial framework to assess the losses flowing from the breach. The arbitrators awarded the majority of the £7.5 million put forward in our report.

Partnership A partner in a firm of solicitors was in dispute over the amount due to him on being forced to resign from the practice. We, by analysis of the firm's accounts, were able to demonstrate that he was entitled to a larger sum than suggested. The matter was settled with the compensation package being twice the original offer.

Insurance claim An explosion occurred at a chemical plant as a result of a leak in a methane pipeline, belonging to another factory, which ran alongside the complex. The insurance company had paid out a large sum under the business interruption clause of the policy and sought to recover from the third party. Our analysis showed that the loss of sales arising from the incident were nowhere as high as assessed by the loss adjuster, who had negligently overlooked certain aspects of the business.
